Wodociągi Miasta Krakowa S.A. (WMK S.A.) pays particular attention to ensuring the appropriate protection of personal data in accordance with the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter the „GDPR”); in particular, WMK S.A. implements appropriate technical and organizational measures and ensures the exercise of data subjects’ rights. This Privacy and Cookie Policy presents matters concerning the processing of personal data by WMK S.A., and WMK S.A.’s use of cookies and similar technologies in connection with users’ browsing of web pages operated by WMK S.A. What data do we process?

We process the data you submit or leave when you browse WMK S.A. web pages (e.g. contact or booking forms) or which we may access during your visits, including data you share in your history of browsing websites and applications, and data that are stored in cookies. In particular, this may be data such as the IP address of the device you are using to browse WMK S.A. web pages.
We also process information which is created during your visit to WMK S.A. web pages (these are random and unique identifiers which allow you to navigate efficiently through WMK S.A. web pages, but which do not allow you to be identified.).
 

What are the purposes of, and legal bases for processing your personal data and how long will they be processed?

Your data are processed for the following purposes and on the legal bases set out below:
  1. In order to enable the use of forms (contact and registration), to measure and analyse network traffic on WMK S.A. web pages, to match the appearance of the web page to the your browser, and also to allow you to navigate efficiently around WMK S.A. web pages, to use online the tools provided on WMK S.A. web pages (in particular, applications forming part of the Integrated Designer Calculator) and to use the online eBOK (customer service) application without having to log in every time. These purposes constitute legitimate interests exercised by WMK S.A. 
    Personal data shall be processed until you submit an objection which obligates WMK S.A. to cease data processing or, in some cases, until you change your web browser settings yourself.
  2. To enable you to use the eBOK online (customer service) application on the basis of your consent given during the registration process and during your visit to WMK S.A. web pages. To use cookies for which your consent is needed. The data will be processed until you withdraw your consent.
  3. To compile statistics about the use of web pages, to collect information on how users use web pages; and to save the settings and personalisation features you have selected based on the consent you granted for using different cookies. The data will be processed until you withdraw your consent.
In every case, information collected and generated ad hoc will only be processed during your browsing of WMK S.A. web pages.
 

Is submitting data obligatory? 

The submission of personal data is voluntary, but, in some cases, if you do not submit the data (including cookies marked as necessary), you may be unable to navigate smoothly through WMK S.A. web pages or use online applications or forms.
 

Your rights

In connection with the processing of personal data on WMK S.A. web pages, you have the following rights:
  • the right to access your personal data and receive their copy;
  • the right to rectify or supplement your personal data;
  • in situations defined by law, the right to have your personal data erased („the right to be forgotten”), to transfer your personal data to another controller and to restrict the processing of your personal data;
  • the right to object to processing of personal data if data are processed on the basis of a legitimate interest;
  • the right to withdraw consent if personal data are processed on the basis of a consent given, whereas withdrawing consent shall not affect the legal compliance of the processing carried out before this withdrawal.

Who are your data provided to?

Your personal data are or may be received by entities entrusted with processing of personal data under an appropriate agreement to achieve the purposes described above, including: IT service providers, payment service providers, marketing agencies (so-called processors), and entities which may request access to data under the law, as well as the Trusted Partners of WMK S.A. Trusted Partners are entities which process your personal data for the purpose of generating statistics or tables that help WMK S.A. offer services, including in particular Facebook, Google, YouTube, Instagram.
 

Links to other pages

Some web pages of WMK S.A. contain links to other web pages, e.g. to Facebook. Links do not use technologies that would automatically transfer your data to entities responsible for other pages. WMK S.A. web pages do not contain technologies such as social media plugins which would enable social media service providers to access your data. When you go to a different website via a link, you should review the privacy policy of the entity responsible for that site.
 

Cookies and similar technologies

During your use of web pages, WMK S.A. may automatically collect data about you, such as your IP address, browser type or operating system. This data may be collected using cookies or similar technologies, such as web beacons or FB pixels.
Cookies should be understood as IT data, in particular text files, that are saved on your terminal device when you browse web pages. Cookies are used, among others, to improve the quality of services provided through web pages and to store your settings and preferences.
The web beacon technology supports monitoring your behaviour on a web page, such as whether you have seen a particular area on a single web page, whether you have moved the cursor onto or clicked interactive items such as buttons and sliders, what content you displayed, marked, or accessed.
An FB pixel is code included on a website, which measures, checks and analyses your behaviour and presents the results of its analysis to make possible adjustments, and to check the effectiveness of information, education and possibly marketing activities carried out by WMK S.A., optimises them based on the collected data and statistics, and builds a target group of future information content.

The above entities place special codes on your terminal devices to collect data that we use to calculate statistics and optimise our services. WMK S.A. itself cannot block the operation of these technologies. However, you may object to data collection by Google, Facebook, YouTube and Instagram software at any time by independently changing the settings of your web browser.
The https://ebok.wodociagi.krakow.pl domain collects, stores, and provides information about users who log into the online eBOK (customer service) application, such as:
  • user name,
  • IP,
  • login date/time,
  • session id.
 

WMK S.A. web pages use the following types of cookies:

  1. Division according to cookie usage and retention time:
  • session – temporary cookies stored on your terminal device until you log off, leave the web page or application, or close the browser;
  • permanent – stored on your terminal device for the period specified in cookie settings or until you delete them.
  1. Division of cookies according to their purpose:
  • necessary – cookies enabling the use of services available on the website; e.g. authentication cookies used for services that require authentication on the website;
  • performance – cookies that enable collecting information about how users use web pages;

Final provisions

The provisions of this Policy are governed by the Polish law.
 

How do I withdraw the consent granted?

  1. To withdraw your consent to collecting cookies, you must delete cookies from your browser (in your browser settings) and then, in the „Cookie consent” message that is displayed when you reload the page, click „GO TO SETTINGS”. A „Cookie Settings” window will then be displayed, in which you can enable the selected cookies by checking the appropriate check box or leave the box empty, which means you refuse the consent for cookies. Then click „SAVE SETTINGS AND CONTINUE TO SITE”.
  2. Personal data, e.g. filled out in contact or booking forms, will be processed according to the information about processing displayed next to the form until you send an objection (e-mail address: iod@wodociagi.krakow.pl) obligating WMK S.A. to cease processing data, or until you withdraw your consent, as described next to the specific form.
  3. The personal information submitted during registration in the online eBOK (customer service) application will be processed until you request deleting your account (e-mail address: iod@wodociagi.krakow.pl), which obligates WMK S.A. to delete your account in the online eBOK application, as described in the Regulations of the Electronic Customer Service Office.
